2. Counter-Notification Procedures

If you believe that material you posted on our website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our designated agent (contact information above). The counter-notification must include the following information:

1. Your physical or electronic signature.
2. An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a proper counter-notification, we will forward it to the original complainant who submitted the DMCA notice. The original complainant will then have 10 business days to notify us that they have filed a legal action seeking a court order to restrain the allegedly infringing activity. If we do not receive such notification, we may reinstate the removed material.

3. Repeat Infringers

It is our policy to terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others. In appropriate circumstances and at our sole discretion, we may disable and/or terminate the accounts of users who may be repeat infringers.

4. Accommodation of Standard Technical Measures

CheapSEOToolz accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, such as digital watermarks or other forms of copyright management information.
